PURPOSE OF THE POSITION: 

CPKC Legal Services is seeking an experienced Legal Counsel to join our dynamic Regulatory group, reporting to the Senior Counsel - U.S. Regulatory. The successful candidate will provide proactive business-oriented legal advice to the corporation at all levels, and will provide support to senior lawyers primarily in the area of Canadian regulatory and commercial law.  The successful candidate must have the ability to work on-site, based in CPKC’s corporate headquarters five days a week.

 

POSITION ACCOUNTABILITIES: 

  • Assist in managing and conducting regulatory proceedings before the Canada Transportation Agency, the Transportation Appeal Tribunal, and other administrative tribunals, as well as before the federal courts (including the federal court of appeal, and the Supreme Court of Canada, as needed), as well as regulatory, commercial and private arbitration and mediation, all in the area of railway transportation law
  • Provide general legal advice in the interpretation, and application of legal concepts and principles relating railway transportation law and related regulatory law, while ensuring alignment with established CPKC policies, practices and procedures
  • Assist in negotiating and drafting commercial rail transportation contracts, interline agreements with connecting railway carriers, and other business development agreements such as construction agreements and business development agreements
  • Assist in developing tariffs and other ancillary terms and conditions of rail transportation services
  • Provide legal opinions as requested by senior Legal Counsel
  • Prepare precedence forms of agreement to reflect current legal trends 
  • Provide instructions, direction and oversight to outside counsel in their performance of CPKC legal work in all matters assigned to outside counsel
  • Provide support to the Legal Services team in other areas of law, including commercial and litigation, as needed from time-to-time

 

POSITION REQUIREMENTS: 

  • Graduate of a recognized law school and membership in the Law Society of one or more of the provinces of Canada
  • Minimum 5 to 7 years of legal practice in a private law firm, or corporate law department
  • Knowledge of transportation and regulatory laws, both federal and provincial, would be an asset
  • Possess strong drafting and analytical skills with keen attention to details and ability to apply applicable legal principles to CPKC business and operations, as well as excellent communication skills to deliver effective, proactive, holistic, strategic legal advice
  • Strong team player with demonstrated experience in participating in multi-faceted transactions and achieving successful results with a diverse group of stakeholders
  • Ability to manage relationships with outside counsel
  • Demonstrated organizational skills to prioritize high volume work load in a time-sensitive environment
  • Excellent interpersonal skills and ability to work independently with minimal supervision

Management Conductor Program:
