PURPOSE OF THE POSITION:

As the Manager, General Claims you will lead a team responsible for investigating incidents involving personal injury or property damage to third parties or property damage to the Company and managing claims for and against the Company arising out of those incidents, including managing risk exposure and loss to the Company.  You will oversee the team’s 24-hour, 7-days-a-week emergency response to those incidents across the Company’s Canadian network (British Columbia, Alberta, Saskatchewan, Manitoba, Ontario and Quebec).

 

POSITION ACCOUNTABILITIES:

  • Develop and implement the claims management and risk mitigation strategy for all third-party casualty claims against the Company and all casualty claims for the Company in Canada, including setting objectives and goals for the General Claims team;
  • Directly manage, and oversee the team in managing, those claims to mitigate the Company’s risk exposure and facilitate timely recovery of the Company’s losses;
  • Physically attend incident scenes, when required by incident-specific circumstances, often on short notice, and guide and direct team members in on-site and remote investigations of incidents that may result in casualty claims against or for the Company;
  • Liaise with internal and external stakeholders to obtain information needed for incident investigations and claims management, and to effectively provide relevant incident-related information to Corporate Risk and other senior management;
  • Analyze and assess the Company’s claims liability and risk exposure resulting from incidents involving third-parties;
  • Provide oversight to the team in setting appropriate reserves for potential Company financial losses resulting from third-party casualty claims; work with CP Legal on litigated matters to assess and log appropriate accruals; review all reserves for accuracy and consistency; and comply with SOX and other reporting requirements concerning casualty claim reserves and management;
  • Directly negotiate claims resolutions, and direct and counsel team on strategies for resolving claims, including negotiating settlements within individual and delegated authority limits;
  • Recover money to recoup the Company’s casualty losses resulting from incidents involving third-parties;
  • Draft and execute settlement release and related documents, and direct, oversee and review settlement releases and related documents prepared by the General Claims team;
  • Provide, and lead the team in providing, support to internal and external counsel representing the Company in casualty litigation, partner with counsel in discoveries, and attend litigation proceedings, such as mediations, depositions, settlement conferences and trials, as appropriate;
  • Set standards for electronic file management for the General Claims team, and preserve and organize all relevant claims-related information through that system;
  • Manage administrative functions of the General Claims team, including matter assignments, on-call scheduling, team inbox, performance reviews, vacation planning, and budget and expense oversight;
  • Ensure consistency in incident response and claims management across the team, including implementing and overseeing compliance with team policies, procedures and protocols, providing coaching and mentoring to team members, and organizing and running team meetings;
  • Keep up-to-date on current developments and trends in claims management practices, and adapt General Claims processes and procedures as warranted;
  • Provide timely and efficient communications and reporting to Director, Casualty Management, and senior management on General Claims matters and issues.

 

POSITION REQUIREMENTS:

  • College degree in business, law, social sciences or humanities, or related fields; specialized courses related to claims management or insurance; or a combination of education and relevant experience;
  • Minimum 3 years of experience managing claims, with casualty claims management experience highly preferred;
  • Previous railroad experience, with knowledge of railroad operating functions, departments, and positions, preferred;
  • Strong analytical, interpersonal communication, and relationship-building skills, with keen attention to detail and accuracy;
  • Effective multi-tasking skills, with an ability to manage competing priorities and quickly shift focus to pressing matters;
  • Self-starter able to work independently with minimal supervision;
  • Knowledge of negligence and other tort law is helpful;
  • Experience with Microsoft Office software suite and with use of shared drive applications preferred.
